No Fault Divorces in Pennsylvania

In Pennsylvania, no-fault divorces can be pursued under two primary grounds:

  • Consent Divorce:
    • Both parties must mutually agree to end the marriage.
    • The agreement must be confirmed by affidavit, in which both parties assert that the marriage is “irretrievably broken” with no prospect of reconciliation.
    • Note that the court will not grant a consent divorce until at least 90 days have passed.
  • Unilateral Divorce:
    • One party alleges that the spouses have lived apart for at least one year, and that the marriage is “irretrievably broken” with no prospect of reconciliation.
    • It is possible for the parties to reside under the same roof if they can provide evidence that they have effectively ceased cohabitating.
