No-Fault Divorces in Pennsylvania

Pennsylvania law recognizes two forms of no-fault divorce:

  1. Consent Divorce
  • Both spouses must agree to end the marriage, and each must sign an affidavit declaring the marriage irretrievably broken, with no reasonable chance of reconciliation.
  • A court may not finalize a consent divorce until at least 90 days have passed from the date the divorce papers were served.
  1. Unilateral Divorce
  • One spouse can request a divorce if they have been living separately from the other spouse for at least one year and can demonstrate that the marriage is irretrievably broken.
  • It is possible for a couple to live in the same residence yet still be considered “separate” if they no longer function as a married couple.
