No-Fault Divorces in Pennsylvania

In Pennsylvania, there are two types of no-fault divorce grounds: (1) consent divorce, and (2) unilateral divorce.

  1. Consent Divorce: A consent divorce requires mutual agreement between both parties. Both spouses must consent to the divorce, and this must be documented in an affidavit. The affidavit must state that the marriage is “irretrievably broken” and that reconciliation is not possible. The court will not grant the divorce before 90 days have passed.
  2. Unilateral Divorce: A unilateral divorce occurs when one party alleges that they have lived apart from the other for at least one year, and that the marriage is “irretrievably broken with no possibility of reconciliation.” In some cases, the spouses may live in the same house but must demonstrate that they have ceased living together as a married couple.
