No Fault Divorces in Pennsylvania

In Pennsylvania, there are two types of No-Fault divorce grounds: (1) consent divorce and (2) unilateral divorce.

  1. Consent Divorce: A consent divorce requires mutual agreement between both parties. Both must agree to the divorce and submit an affidavit stating that the marriage is “irretrievably broken” with no possibility of reconciliation. The court will not grant a consent divorce until at least 90 days have passed.
  2. Unilateral Divorce: For a unilateral divorce, one party must declare that the couple has been living apart for at least one year and that the marriage is “irretrievably broken with no chance of reconciliation.” The couple can still live in the same house if it is proven they have stopped cohabiting.
