In Pennsylvania, there are two types of no-fault grounds for divorce: (1) consent divorce and (2) unilateral divorce.
- Consent Divorce: For a consent divorce, both spouses must mutually agree to the divorce, and their consent must be confirmed through an affidavit. The affidavit must state that the marriage is “irretrievably broken” and that there is no chance of reconciliation. The court will not grant the divorce until at least 90 days have passed.
- Unilateral Divorce: In a unilateral divorce, one spouse must declare that the couple has lived apart for at least one year and that the marriage is “irretrievably broken” with no possibility of reconciliation. It is possible for the parties to live in the same house but must prove they have stopped cohabiting.
