No-Fault Divorces in Pennsylvania

In Pennsylvania, there are two types of no-fault grounds for divorce: (1) consent divorce and (2) unilateral divorce.

  1. Consent Divorce: For a consent divorce, both parties must mutually agree to the divorce, and this agreement must be confirmed through an affidavit. The affidavit must state that the marriage is “irretrievably broken” and that there is no possibility of reconciliation. The court cannot grant a consent divorce until at least 90 days have passed.
  2. Unilateral Divorce: In a unilateral divorce, one party must claim that the couple has been living apart for at least one year and that the marriage is “irretrievably broken” with no chance of reconciliation. The parties can live in the same house, as long as it can be proven that they no longer cohabit.
