No-Fault Divorces in Pennsylvania

Pennsylvania recognizes two kinds of no-fault divorce:

  1. Consent Divorce
    • Both spouses must agree to end the marriage and confirm their agreement in an affidavit stating the marriage is “irretrievably broken” and that reconciliation is not possible.
    • The court cannot finalize a consent divorce until 90 days have passed.
  2. Unilateral Divorce
    • One spouse may file if the couple has lived apart for at least one year, coupled with an affidavit that the marriage is “irretrievably broken.”
    • It is possible to live “apart” under the same roof if it can be shown there is no longer a marital relationship (i.e., no cohabitation).
