No-Fault Divorces in Pennsylvania

Pennsylvania recognizes two types of no-fault divorce:

  1. Consent Divorce
    • Both parties agree and confirm via affidavit that their marriage is “irretrievably broken” with no possibility of reconciliation.
    • A court will not grant this type of divorce until 90 days have passed following the filing.
  2. Unilateral Divorce
    • One spouse asserts that the couple has lived separately for at least one year and that the marriage is “irretrievably broken” with no chance of reconciling.
    • “Living apart” can include residing under the same roof if it’s shown that genuine cohabitation has ended.
