Termination of a Custody Order
A custody order typically ends if:
- The custodial parent passes away (in which case the surviving parent usually gains custody, provided they are deemed fit).
- The child reaches the age of majority.
- A court orders the custody arrangement to terminate.
Relocation Requirements
Relocation with a child generally requires:
- Consent from all individuals with custodial rights or court approval of the move.
- At least 60 days’ advance notice to other parties who hold custodial rights, unless there is a valid reason for shorter notice (in which case the relocating party has 10 days from when they first become aware of the need to relocate).
- The party proposing the relocation must prove it is in the child’s best interest.
When deciding on relocation, courts consider many of the same factors used in standard custody rulings, placing special emphasis on the child’s safety.
